Does Awaab's Law apply to private renters? Not yet — here's the timeline
Short answer for October 2026: if your landlord is a private company or an individual, Awaab's Law deadlines do not bind them yet. The power to extend it exists — but exercising it is the subject of a consultation, not a law in force.
Extension timeline as it stands
| Date | What happened |
|---|---|
| 2024-10 | Labour manifesto commits to extending Awaab's Law to the private rented sector. 3 |
| 2025-10-27 | Awaab's Law commences for social landlords (phase 1). Same day: Renters' Rights Act 2025 receives Royal Assent, including the section 60/61 extension powers. 3 |
| 2026-10-09 | MHCLG opens consultation on applying Awaab's Law to private rented tenancies and licensed accommodation (closes 18 December 2026). 3 |
| TBC | Commencement regulations for private landlords still to be made — no date confirmed as of 14 October 2026. Section 60 remains 'Prospective' on legislation.gov.uk. 4 |
What the consultation tells us
- MHCLG ran a consultation on extending Awaab's Law to the private rented sector, temporary accommodation, supported housing and care leaver accommodation from 9 October 2026 to 11:59pm on 18 December 2026 (England only). 3
- Phase 2 (from 30 November 2026) was confirmed in the consultation foreword by the Housing Minister, alongside 'test and learn' tweaks including clarifying hazard thresholds and avoiding duplication with existing fire safety rules. 3
Note the direction of travel in that foreword: it explicitly promises "legally enforceable deadlines" for private landlords, and extends the conversation to temporary accommodation, supported housing and care leaver accommodation (the occupancy-under-licence gap, currently outside the law entirely). Private landlords who want warning should read section 4 of the consultation; the impact assessment annex quantifies what MHCLG thinks compliance will cost.
What private renters can use today, instead
| Tool | How it works | Key limit |
|---|---|---|
| Environmental Health / HHSRS inspection (Housing Act 2004) | Council officers assess hazards under the Housing Health and Safety Rating System (HHSRS); the highest-rated hazards trigger a duty on the council to act, via improvement or emergency notices | Depends on council resourcing; no fixed response clock |
| Section 11 Landlord and Tenant Act 1985 | Implied repairing obligation for structure and damp-proofing; damages/injunction via county court, often after a survey report | "Reasonable time" is undefined — no 10-day clock |
| Fitness for human habitation test (Housing Act 2004 s.2) | Used in HHSRS and disrepair claims; mould counts via the statutory nuisances route too (EPA 1990) | Slow; evidence-heavy — the evidence pack still applies |
| Council-specific schemes | Some councils (e.g. various London boroughs) run private-rented mould/damp initiatives and enforcement pledges | Postcode lottery; check your council |
The practical advice is the same either way: report in writing, demand inspection, log everything. The evidence pack works for private cases too — just leave the Awaab's Law deadline column empty until commencement regulations land. Landlords: when it does land, your records are your s.10A(5)-style defence, so start keeping them now.
